WEDNESDAY, MARCH 21, 2007:
The Adams County Board of Commissioners met this date in regularly scheduled session at 9:00 a.m. in the Commissioners’ Meeting Room with Board Chairman R. Glenn Snyder presiding. Others in attendance were Commissioners Lucy Lott and Thomas J. Weaver; Solicitor John Hartzell; Glenn Hartzel and Denis Sullivan, County Auditors; Chris Toms, C.S. Davidson; News Reporters John Messeder (The Gettysburg Times), Caitlyn Heaney (Evening Sun); Max Stevens (WGET) and Chief Clerk Paula V. Neiman.
Minutes:
Mr. Weaver moved, seconded by Ms. Lott, to approve the Minutes of the March 14, 2007 Commissioners’ Meeting as presented.
Motion carried.
Salary Board Meeting:
Mr. Weaver moved, seconded by Ms. Lott, to recess the Salary Board Meeting until 9:30 a.m. this date.
Motion carried.
Proclamation:
Mr. Snyder moved, seconded by Ms. Lott, to adopt and proclaim the
month of April 2007 as “FAIR HOUSING MONTH” in Adams County. This
proclamation was presented Anne Thomas, who has been appointed Fair
Housing Officer for Adams County.
Motion carried.
Public Comments/Questions:
No public comments/questions were addressed to the Board at this time.
Community Development Block Grant:
With recommendation from Anne Thomas, Grants Coordinator, Mr. Weaver moved, seconded by Ms. Lott, to approve and sign a Resolution authorizing the submission of an application for the 2007 CDBG Funds to the Pennsylvania Department of Community & Economic Development in the final allocation amount of $381,690 to the following agencies:
- Franklin Township – LMI Sewer Hookups $ 134,000
- HART CENTER $ 85,986
- Roots & Wings Arts Program $ 9,000
- SCCAP – Asset Development Services $ 19,000
- York Springs – Water Storage Tank $ 65,000
- Administrative & Planning (18%) $ 68,704
TOTAL $ 381,690

Fair Housing:
Ms. Lott moved, seconded by Mr. Weaver, to appoint Anne Thomas as the Fair Housing Officer for the County of Adams effective March 21, 2007.

Court:
Mr. Weaver moved, seconded by Ms. Lott, to approve the appointment of the Adams County Clerk of Courts Office as the Criminal Matters Collection Agency for purposes of 18 Pa. C.S.A. § 1106.
Motion carried.
South Central Caucus of the County Commissioners:
Ms. Lott moved, seconded by Mr. Snyder, to approve to adopt Resolution No. 2 of 2007 of Adams County support for the development of the South Central Regional Action Plan for Land Use, Transportation and Economic Development.

And now this 21st day of March, 2007, Adams County concurs with the scope of work presented herein and expresses our willingness to participate in the development of the South Central Regional Action Plan for Land Use, Transportation and Economic Development.

Adams County Adult Correctional Complex:
With recommendation from Warden Deborah Hankey, Mr. Weaver moved, seconded by Ms. Lott, to approve and direct that all defendants released from the Adams County Adult Correctional Complex since January 1, 2004 and hereafter with negative Inmate Account balances as a result of nonpayment of inmate service fees, administrative fees, replacement/restitution fees, work release fees, weekender fees and medical expenses incurred during their incarceration have that balance added to the defendant’s account by the Adams County Clerk of Court’s Office.

Commissioners:
Mr. Weaver moved, seconded by Ms. Lott, to approve and authorize Chairman R. Glenn Snyder to sign between the County of Adams and Shipley Energy Co., 550 East King Street, York, PA the following Shipley Natural Gas Sales Agreements:
- Gas contract price of $8.59 per Dth effective May 1, 2007 through October 31, 2007
- Transmission cost – Nymex + $2.33 per Dth effective November 1, 2007 through October 31, 2008

Green Space Committee:
Ms. Lott moved, seconded by Mr. Snyder, to approve to adopt Resolution No. 3 of 2007 Adopting a Program Entitled “Green Space Grant Program”.

RESOLUTION NO. 3 of 2007
Adams County, Pennsylvania
A RESOLUTION OF THE BOARD OF COMMISSIONERS
OF ADAMS COUNTY, ADOPTING A PROGRAM ENTITLED
GREEN SPACE GRANT PROGRAM
WHEREAS, the County of Adams desires and intends to participate in a County Green Space Program; and
WHEREAS, the Board of Commissioners of Adams County have appointed the members of the Green Space Committee to administer the Green Space Grant Program; and
WHEREAS, the citizens of Adams County believe in the protection of land in our county to preserve our rural heritage, our agricultural and tourism economies, our clean water and our clean air; and provide recreational opportunities; and
WHEREAS, the Commissioners of Adams County are focused on enriching and sustaining the quality of life for current and future generations; and
WHEREAS, County planning studies have identified opportunities for Green Space conservation efforts; and
WHEREAS, research has shown it is more economically feasible to preserve open space than it is to support more acres of populated land; and
WHEREAS, the Adams County Commissioners have supported a County program for agricultural land preservation since 1989; and
WHEREAS, the County of Adams has partnered with the Land Conservancy of Adams County, the Forest Legacy Program and other land preservation programs; and
WHEREAS, the Adams County Commissioners have been working with the Keep Adams Green Committee to develop a plan to preserve viable county lands; and
WHEREAS, the County desires to work in partnership with municipalities and to have the municipalities work in partnership with each other to achieve these goals.
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of Adams County that:
- We will support a program preserving open space in Adams County that will include but not be limited to agricultural land, natural resources, parks and recreational areas and cultural and historical resources.
- We will finance this program yearly with a minimum of $1 million dollars in the County’s general budget, beginning in 2008, with a minimum of 60% allocated to agricultural land preservation.
3. We are dedicated to finding a long range funding source to minimize the financial impact on our residents.

Act 137:
Ms. Lott moved, seconded by Mr. Snyder, Approve a request from South Central Community Action Program for a grant in the amount of $30,000 of Act 137 Funds to support rehabilitation projects for low-income elderly individuals (age 62 and above) who do not qualify for other rehab programs operated by the Agency.

Green Acres:
Ms. Lott moved, seconded by Mr. Weaver, to approve to authorize Board Chairman Snyder to sign Green Acres Renovation Contract Change Order No. G-2 dated March 21, 2007 in the amount of $14,014.30.

Mr. Weaver moved, seconded by Ms. Lott, to approve the Personnel Report dated March 14, 2007 as follows:
Human Resources:
Approve the employment of Dennette Moul, HR Director, effective March 21, 2007.
Children & Youth:
Recommendation from Peter Vriens, Administrator, to approve the employment of Sabrina Warrenfeltz, Caseworker 2, effective April 10, 2007.

Board Chairman Snyder noted the receipt of the Juvenile Probation Caseload Report for February 2007.

Ms. Lott moved, seconded by Mr. Snyder, to approve the following expenditures:
General Fund $ 237,660.91

Children & Youth $ 126,885.02
Law Enforcement $ 88.30

Conditional Use Hearings:
Board Chairman Snyder noted there will be two conditional use hearings held today, Wednesday, March 21, 2007. Cornelis Oussoren, 1555 Goldenville Road located in Butler Township at 10:00 a.m. and Stephen & Melissa Clabaugh, 245 Granite Station Road located in Mt. Pleasant Township at 10:30 a.m.
